Attorney General Davenport joins coalition opposing new federal funding certification proposal

Attorney General Jennifer Davenport joined a group of 23 attorneys general on Mar. 30 to oppose a proposed rule by the General Services Administration that would require federal funding recipients to certify compliance with broad terms related to diversity, equity, and inclusion.

The coalition said the proposal could create unnecessary obstacles for state agencies, nonprofits, schools, and other organizations seeking federal funds. The attorneys general argue that the measure is unlawful and may discourage participation in lawful activities.

“This is an insidious attempt to weaponize the federal government’s funding process. It affects every State department and agency as well as all nonprofits, charities, or schools that receive federal funds,” said Attorney General Davenport. “Instead of making life more affordable for New Jerseyans, the Trump Administration is obsessed with finding new ways to hold federal funds hostage to ideological battles.”

The proposed requirement would amend standard certifications required during registration for SAM.gov—the government’s System for Award Management—by asking applicants and recipients not to engage in what it calls “illegal DEI.” It references President Trump’s executive order on “Ending Illegal Discrimination and Restoring Merit-Based Opportunity” along with Department of Justice guidance discouraging programs promoting diversity, equity, and inclusion.

The letter from the attorneys general requests that GSA withdraw its proposal on grounds including violations of the Paperwork Reduction Act, Administrative Procedure Act, and constitutional spending provisions. They also say it could chill protected speech.

According to the official website, New Jersey Attorney General Matthew Platkin leads efforts across all counties in protecting residents’ lives and property while upholding legal standards statewide. The office provides legal representation for state agencies, oversees law enforcement activities throughout New Jersey’s municipalities, operates crime labs supporting investigations, advocates for victims’ rights, enforces consumer protection initiatives, and regulates public safety matters under its statutory mandate.
