New Jersey makes outdoor dining permanent with new legislation

Governor Phil Murphy has signed legislation making outdoor dining a permanent feature for restaurants and certain alcoholic beverage retailers in New Jersey. The law, initially set to expire on November 30, 2024, will now continue indefinitely, allowing businesses to expand their service areas into designated outdoor spaces.

Governor Murphy stated, "Outdoor dining has proven to be an incredibly successful venture over the past four years, benefiting business owners and patrons alike." Attorney General Matthew J. Platkin added his support, noting the positive impact on downtowns and communities.

The new law allows holders of temporary expansion permits from the New Jersey Division of Alcoholic Beverage Control (ABC) to convert these permits into permanent ones with annual renewals upon local approval. Kirstin Krueger from the Division of Alcoholic Beverage Control described this as a "commonsense approach" that aligns with changing customer preferences.

Tim Sullivan from the Economic Development Authority highlighted how outdoor dining helped restaurants remain operational during the pandemic and will continue to revitalize communities by attracting foot traffic and economic activity.

The legislation's primary sponsors include Senator Paul A. Sarlo, Senator Vincent J. Polistina, Assemblyman Roy Freiman, Assemblywoman Mitchelle Drulis, and Assemblywoman Barbara McCann Stamato. Senator Sarlo emphasized its benefits for both economies and local residents. Senator Polistina remarked on the flexibility it provides businesses to thrive post-pandemic.

Assemblyman Freiman called it a lifeline for establishments during COVID-19 that now fosters community-centered spaces. Assemblywoman Drulis pointed out that constituents have asked for more business flexibility and vibrant local spaces. Assemblywoman Stamato stressed its role in supporting diverse local businesses.

Michael Egenton from the New Jersey State Chamber of Commerce commended Governor Murphy for extending outdoor dining rules as they drive economic development across towns. Natalie Pineiro from Downtown New Jersey echoed similar sentiments about enhancing community vibrancy.

Carlos Medina of the Statewide Hispanic Chamber of Commerce praised it as a pro-business model transforming adversity into opportunity for Latino-owned restaurants. Scott Wells from Bolero Snort Brewing Company noted its popularity among customers at craft breweries statewide.
