Americans for Prosperity opposes renomination of Lauren McFerran to NLRB

Americans for Prosperity, a grassroots organization, has called on senators to reject the renomination of Lauren McFerran to the National Labor Relations Board (NLRB). The group argues that McFerran's leadership during the Biden-Harris Administration has resulted in a "destructive and legally questionable labor law regime." They claim this approach was rejected by Congress, courts, and voters in the recent election where President Donald Trump secured 312 electoral college votes.

The statement from Brent Gardner, Chief Government Affairs Officer of Americans for Prosperity, highlights several concerns with the NLRB under McFerran. It alleges that the board prioritized special interests over workers' rights and attempted to eliminate secret ballot union elections. The board's efforts allegedly allowed unions to be certified via "card-check" authorization, which reportedly led to harassment and intimidation by union organizers.

Furthermore, Gardner points out attempts by the NLRB to undermine freelance work and small business franchising. He notes that more than 80% of freelancers prefer their independent status over traditional employment. Additionally, franchising is described as critical for entrepreneurial opportunities employing nearly 9 million Americans and generating $900 billion in economic activity.

Another criticism is directed at instances where employers were reportedly prevented from protecting employees against discriminatory language in the workplace if it occurred during union activities. Americans for Prosperity argues that reconfirming McFerran would entrench failed policies into President Trump's term until August 2026.

The organization urges senators not to support McFerran's renomination and emphasizes its significance by stating: "This vote will be recorded in our legislative scorecard."
